Terms of Service

Welcome to eWindowDisplays, available at eWindowDisplays.com (the “Service”), a website and Internet-delivered service provided by T Marr IT Services (UK) (“We,” “Us,” “Our”) which offers a Window Signage Design and Display web application. By using the Service You agree to these Terms of Service (“Terms”) and the Privacy Policy incorporated into these Terms by reference.

Certain capitalized words in the Terms have the following meaning:

• “You” or “Your” means the person or entity using the Service.
• “Your Data” means text or images that were entered or uploaded by You as a user of the Service.
• “Content” means the compilation and scheduling of “Your Data” in web page format that We make available through the Service.

We reserve the right to change the Terms at any time. Changes to the Terms will be posted here, so please periodically check this page for changes. Your continued use of the Service following the posting of changes to these Terms will mean your acceptance of those changes.

THE SERVICE

The Service is the property of T Marr IT Services and protected by copyright law in the UK and in other countries.

You are responsible for

• obtaining access to the Internet and the Service
• any fees incurred from third parties such as Internet service providers
• all equipment necessary to access the Service and to display Your Content

You are permitted to view, digitally copy, and print Content from this Service without restriction provided You respect the owner copyright of third party images wherever used

You may not, except as otherwise permitted in these Terms:

• Modify, reproduce, or distribute any Content without the express written permission of Us.
• Provide third party access to any portion of the Service or its Content (including providing Your account name or password) for commercial purposes other than to outsource the design of Your Content.
• Use the Service to engage in fraudulent or illegal activities.

The Service will be periodically updated with new features, improvements, and fixes, and You will be notified of these changes via the clickable Service version number displayed in the header bar.

REGISTRATION

To sign up for an account, You are required to provide Personal Data through a registration process which requires the entry and validation of Your email address. By registering You represent that You will

• provide true, accurate, current and complete information about Yourself (“Registration Data”)
• ensure the Registration Data is kept accurate, current and complete.

Note that We may terminate Your account if You provide false information.

Registration entitles you to access a fully functioned version of the Service for a one month Trial period.

• Trial Access users agree to be bound by the Terms and our Privacy Policy.
• You may subscribe at any time during the Trial period.
• At the end of the Trial Access period the Content of the registered account will be set to read only mode unless a monthly payment for continued use of the Service is made.
• If a subscription payment to the Service is not made within six months of the initial registration then all Your Data and Content could be permanently removed.

SECURITY

You are responsible for maintaining the confidentiality of Your username and password and are fully responsible for all activities that occur under Your account. You must

• immediately notify Us of any unauthorized use of Your account or any other breach of security
• ensure that on any device accessible by multiple users You exit from Your account at the end of each session.

We are not liable for any loss, damage or disclosure arising from Your failure to comply with this Section.

PRIVACY POLICY

Collection and use of Registration Data and certain other information about You is subject to our Privacy Policy. You agree to the transfer of this information to the UK for storage, processing, and use by Us and Our service providers. The Privacy Policy is hereby incorporated into these Terms by reference.

FEES

The Service is available as a monthly-paid subscription of GBP27.50, with a reduced monthly rate of GBP20 for all charitable organisations such as churches. You agree to pay to T Marr IT Services all fees for subscriptions purchased on or through the Service. If these subscription rates should change We will email You a notification of such change at least 30 days in advance.

Your Service subscription will continue until You cancel it, and Your credit card or PayPal account will be charged automatically on or about the same date each month. All customers will be charged the applicable subscription fee in sterling (GBP) pounds.

You may cancel Your subscription any time via the eWindowDisplays contact Us form using the subject line “Cancel my Account”. Upon acknowledgement of a confirmatory email to your registered email address Your monthly subscription payments will then cease and Your Content will be frozen for a maximum period of 6 months, or earlier on request.

DATA

We do not claim ownership of Your Data, nor does the Service contain publicly accessible areas where You can share Your Data. While We provide reasonable security for Your Data, the Service should not be used for storage of sensitive or regulated data. We may access, preserve, and disclose Your account information and Your Data, if required, to

• Comply with legal requirements.
• Enforce the Terms.
• Respond to Your requests for support.

LIMITS

You acknowledge that We have established certain limits concerning use of the Service, including

• the maximum server space allocated to Your account for the storing of uploaded images is 250MB. Further allocations can be made at an additional cost of 5GBP per month per 100MB or part thereof.
• Window Displays generated on Your account cannot be displayed on more than one screen simultaneously.
• Only images up to 5MB can be uploaded, and their size will be reduced if either of their dimensions exceeds 2000 pixels.

We may modify these limits as appropriate from time to time.

CANCELLATION AND TERMINATION

If You cancel Your subscription Your Data will not automatically be deleted from the Service. An account with a cancelled subscription will be placed in a read-only mode where You should be able to access, but not modify or display Your Data. On cancellation We will store Your Data for a maximum of six months from the time of cancellation. If after this period you have not re-subscribed We may delete Your Data, Registration Data and Personal Data at Our discretion and without notice.

We may, under certain circumstances and without prior notice, immediately terminate Your account and/or Your access to the Service, and delete Your Data. Causes for such termination shall include, but not be limited to

• breaches or violations of these Terms
• compliance with court orders or legal enforcement notices.

All terminations for such causes shall be made in Our sole discretion and may include barring further use of the Service. We shall not be liable to You or any third-party for any suspension or termination of Your account, for the inability to access the Service or for the deletion of Your Data.

DISCLAIMERS

• Your use of the Service is at Your sole risk, and is provided on an “As is” and “As available” basis.
• We make no warranty that the Service will meet your requirements, be uninterrupted or error-free
• No advice or information supplied to You by Us shall create any warranty not expressly stated in these Terms
• We shall not be liable to You for the use or the inability to use the Service or for any unauthorised access to or alteration of Your Data or Content

NOTIFICATIONS

We will notify You of changes to these Terms either by email or by postings on the Service.

Any notice You desire to send to Us may be sent by email to info@ewindowdisplays.com.

GENERAL

• These Terms constitutes the entire agreement between You and Us and governs Your use of the Service.
• These Terms and the relationship between You and Us shall be exclusively governed by the laws of England and Wales.
• Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
